These terms govern your use of mlsrt.com and mlsroundtable.com (the “Site”), operated by T3 Sixty, LLC on behalf of the Real Estate Data Roundtable. By using the Site you agree to them. If you do not agree, please do not use the Site.
About the Roundtable
The Real Estate Data Roundtable is a think tank of multiple listing service organizations, convened and managed by T3 Sixty, LLC. It discusses industry issues and, when appropriate, fosters dialogue or issues an opinion.
Permitted use
You may access the Site and read, download and print its content for your own informational, non-commercial use, and for internal use within your organization. You may quote briefly from published content with attribution to the Real Estate Data Roundtable.
Restrictions
You may not: republish or redistribute Site content as your own; sell, sublicense or commercially exploit it; remove or alter attribution, copyright or trademark notices; use automated means to scrape or harvest the Site in a manner that burdens it; or use the Site in violation of any applicable law.
Intellectual property
Site content, including text, layout, graphics and published research, is owned by T3 Sixty, LLC or its licensors and is protected by copyright and other laws. Member organization names and logos are the trademarks of their respective owners and appear on the Site to identify Roundtable membership. Their appearance does not imply that those owners endorse this Site’s content beyond their participation in the Roundtable.
Research reports
Downloadable reports are additionally governed by the End User License Agreement. Where that agreement and these terms conflict as to a report, the End User License Agreement controls.
No professional advice
Site content is provided for general information about the real estate industry. It is not legal, financial, tax, antitrust or other professional advice, and must not be relied on as a substitute for advice from a qualified professional who knows your circumstances. Nothing on the Site is an invitation or agreement among any parties to fix prices, allocate markets, or restrain trade in any manner.
Accuracy and data
Membership figures, subscriber counts and other statistics are drawn from research and from information supplied by the organizations concerned. They are accurate to the stated measurement date and to the best of our knowledge, but are estimates that change over time. The Site is provided on an as-is basis and content may be updated or withdrawn at any time without notice.
Third-party links
The Site links to third-party websites. Those sites are not under our control, and we are not responsible for their content, accuracy or practices. A link is not an endorsement.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.
Limitation of liability
To the fullest extent permitted by law, neither T3 Sixty, LLC, the Real Estate Data Roundtable, nor its member organizations will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or relating to your use of or inability to use the Site, even if advised of the possibility of such damages. Some jurisdictions do not allow certain of these limitations, in which case they apply to the maximum extent permitted.
Indemnity
You agree to indemnify and hold harmless T3 Sixty, LLC and the Real Estate Data Roundtable from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Site or breach of these terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. The state and federal courts located in Orange County, California will have exclusive jurisdiction over any dispute arising from these terms or the Site, and you consent to their jurisdiction and venue.
Changes to these terms
These terms may be updated from time to time. Continued use of the Site after a change takes effect constitutes acceptance of the revised terms.
